Terms and Conditions
These Terms and Conditions apply to all services provided by SPS Drainage (“we”, “us”, “our”) to our customers (“you”, “your”).
1. Services
SPS Drainage provides drainage services, including but not limited to drain inspections, drain unblocking, CCTV drain inspections, drain repairs, maintenance and other drainage-related works.
2. Quotations
All quotations are valid for 30 days unless otherwise stated. Quotations are based on the information available at the time and may be revised if additional work is required or unforeseen issues are discovered during the course of the work.
3. Booking and Acceptance
A booking is confirmed once it has been accepted by SPS Drainage. By booking our services, you agree to these Terms and Conditions.
4. Deposits
For larger works, a deposit of 50% of the quoted price is required before work commences.
Deposits are non-refundable if you cancel the work after booking or fail to provide access at the agreed time, except where we agree otherwise in writing.
5. Payment
Payment is due immediately upon completion of the work unless alternative payment terms have been agreed in writing before the work starts.
We accept payment by:
- Cash
- Debit/Credit Card
- Bank Transfer
If payment is not received by the due date, we reserve the right to charge interest on the outstanding balance in accordance with applicable law and/or recover any reasonable costs incurred in collecting the debt where permitted. We also reserve the right to refer unpaid accounts to a third-party debt recovery agency, and any additional recovery costs permitted by law may be added to the outstanding balance.
6. Ownership of Materials
Any materials, parts, equipment, or goods supplied by SPS Drainage shall remain the property of SPS Drainage until full payment has been received and cleared.
We reserve the right, where legally permitted, to recover or remove any unpaid materials if payment is not made in accordance with these Terms and Conditions.
7. Customer Responsibilities
You are responsible for:
- Providing safe and reasonable access to the property.
- Ensuring someone is available if required during the appointment.
- Informing us of any known hazards before work begins.
- Providing accurate information relating to the drainage issue.
If access cannot be gained upon arrival, a call-out charge or aborted visit fee may apply.
8. Drain Blockage Clearances
While we use professional equipment and techniques to clear blockages, we cannot guarantee that a blockage will not return.
Due to the nature of drainage systems and external factors beyond our control, no warranty is provided on drain blockage clearance services.
If a blockage reoccurs and, upon inspection, we determine that it has been caused by misuse of the drainage system (including, but not limited to, the disposal of unsuitable items such as wet wipes, sanitary products, fats, oils, grease, or other inappropriate materials), any further attendance, clearance work, or repairs will be chargeable at our standard rates.
9. Warranty on Repair Works
Where a warranty is offered on repair or installation works, the warranty applies only to the specific work carried out by SPS Drainage.
The warranty will be void if, in our reasonable opinion:
- The drainage system has been misused.
- The damage has been caused by customer negligence.
- New blockages are caused by inappropriate items entering the drainage system.
- The drainage system has been altered or repaired by another party.
The length and scope of any warranty will be confirmed in writing at the time of the work.
10. Additional Work and Hidden Defects
Quotations are based on the visible condition of the drainage system at the time of inspection. Hidden defects, collapsed pipework, root ingress, damaged connections, or other unforeseen issues may only become apparent once work has commenced.
Where additional work is required, SPS Drainage will inform you and provide a revised quotation where reasonably practicable before proceeding.
11. Limitation of Liability
We will carry out all work with reasonable care and skill.
To the fullest extent permitted by law, SPS Drainage shall not be liable for:
- Pre-existing defects in the drainage system.
- Damage caused by hidden defects or collapsed drains.
- Repeat blockages caused by misuse, structural defects, tree roots, or other factors beyond our control.
- Indirect or consequential losses.
Nothing in these Terms excludes or limits liability where it cannot legally be excluded under the laws of England and Wales.
12. Cancellation
Customers may cancel an appointment by contacting us as soon as possible.
For larger works where a deposit has been paid, the deposit is non-refundable unless SPS Drainage agrees otherwise.
13. Health and Safety / Right to Refuse Work
We reserve the right to refuse or stop work where:
- Conditions are unsafe.
- There is a risk to our staff, contractors, members of the public, or property.
- The requested work is unlawful or cannot be completed safely using suitable working practices.
Any charges incurred up to the point work is stopped will remain payable.
14. Aborted Visits
If we attend a pre-booked appointment and are unable to carry out the work due to:
- No access being available.
- No one being present at the agreed appointment time.
- Incorrect or misleading information being provided.
- Circumstances beyond our reasonable control.
We reserve the right to charge an aborted visit or call-out fee.
15. Waste Disposal
Any waste removed during the course of our work will be disposed of responsibly and in accordance with all applicable environmental legislation, unless otherwise agreed with the customer.
16. Customer-Owned Equipment and Drainage Systems
SPS Drainage accepts no responsibility for damage to customer-owned equipment, pipework, fittings, or drainage systems where such damage results from pre-existing defects, age-related deterioration, poor installation, structural failure, or conditions that could not reasonably have been identified before work commenced.
17. Privacy
SPS Drainage only collects and retains the information necessary to provide our services, including your name, address, and contact details.
We do not sell, share, or use your personal information for marketing purposes.
We may take photographs and videos of our work before, during, and after completion for quality records and to promote our services on our website and social media platforms. These images and videos will not include personal information or anything that could reasonably identify you or compromise your privacy without your permission.
If an image or video may identify you or your property in a way that raises privacy concerns, we will seek your consent before using it for marketing purposes.
18. Complaints
If you are unhappy with our service, please contact us as soon as possible. We will investigate your complaint and aim to resolve it promptly and fairly.
19. CCTV Drain Inspections
CCTV drain inspections carried out by SPS Drainage provide an assessment of the condition of the drainage system based on what is visible and accessible at the time of the inspection.
Inspection findings are limited to the areas that can be accessed by the CCTV equipment and do not guarantee that hidden defects or future issues will not arise.
Any recommendations made following a CCTV inspection are based on the conditions observed at the time of the inspection and should not be interpreted as a guarantee of the future condition or performance of the drainage system.
20. Working Hours and Delays
We will make every reasonable effort to attend appointments at the agreed time. However, due to the nature of emergency drainage work, traffic conditions, weather, and other unforeseen circumstances, arrival times are estimates only and may be subject to change.
We will endeavour to keep customers informed of any significant delays.
21. Acceptance of Terms
By accepting our quotation, booking our services, paying a deposit, or allowing work to commence, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
22. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales unless otherwise required by applicable law.
